1. About the service. YT Picker lets you import public comments from a YouTube video and select one or more random winners for a giveaway or contest. The service is provided through our website, and features may vary depending on whether you are using free trials or a paid plan. We may add, change, or remove features over time to improve the tool.
2. Eligibility. To use YT Picker, you must be old enough to form a binding contract in your country and able to comply with these terms. If you use the service on behalf of a company or organization, you confirm that you have the authority to accept these terms for that organization.
3. Accounts. Some features require an account. You are responsible for the information you provide, for keeping your login details secure, and for all activity that happens under your account. If you believe your account has been accessed without your permission, tell us at [email protected] as soon as possible. We are not liable for losses caused by unauthorized use of your account where you failed to keep your credentials safe.
4. Free trials and paid plans. YT Picker offers 3 free trials so you can test the service before paying. Details of the free trials and paid plans, including what each plan includes, are shown on our pricing page at https://ytpicker.com/pricing. We may change our plans and prices, and any changes will apply going forward rather than to periods you have already paid for. Where a change affects an active paid plan, we will give you reasonable notice.
5. Payments. If you choose a paid plan, you agree to pay the fees shown at the time of purchase. Payments are handled by our payment provider, and by paying you also agree to their terms. Unless stated otherwise or required by law, fees are non-refundable once a plan is active and its features have been made available to you. You are responsible for any taxes that apply to your purchase.
6. Acceptable use. You agree to use YT Picker only for lawful giveaways and contests and to run them honestly. You must not use the service to break the law, to run fraudulent or deceptive giveaways, to harass or harm others, to violate anyone's rights, to attempt to gain unauthorized access to our systems, to interfere with or overload the service, or to copy, resell, or redistribute the tool as your own. You also agree to follow YouTube's own terms and any rules that apply to promotions on their platform. Running a giveaway is your responsibility, including making sure it complies with the laws and platform rules that apply to you.
7. Fair use and limits. To keep the service reliable for everyone, we may set reasonable limits on how the tool is used, such as the number of draws or the size of comment imports on certain plans. If we notice usage that looks abusive, automated in a way that harms the service, or designed to get around plan limits, we may restrict or suspend access.
8. Public data and YouTube's role. YT Picker works with publicly available YouTube comment data. We do not control YouTube, and the availability, format, and accessibility of comments depend on YouTube and on the settings chosen by video owners. If a video has comments disabled, is private, or otherwise restricts access, the tool may not be able to import entries. We are not responsible for limitations that come from YouTube or from a video's own settings.
9. Intellectual property. YT Picker, including its name, design, text, and software, is owned by us or our licensors and is protected by intellectual property laws. These terms do not give you any ownership of the service. You may use the tool as intended, but you may not copy, modify, reverse engineer, or create derivative works from it except where the law allows.
10. Your responsibility for giveaways. You are solely responsible for the giveaways and contests you run using YT Picker, including the prizes you offer, the rules you set, the way you communicate with entrants, and the delivery of prizes to winners. YT Picker selects winners at random from the entries you provide; we are not a party to your giveaway and take no responsibility for how it is run or its outcome.
11. Disclaimers. The service is provided on an "as is" and "as available" basis. While we work hard to keep YT Picker accurate and available, we do not promise that it will always be uninterrupted, error-free, or free from delays. To the fullest extent allowed by law, we disclaim warranties that are not expressly stated in these terms.
12. Limitation of liability. To the fullest extent permitted by law, YT Picker and its team will not be liable for indirect, incidental, or consequential damages, or for lost profits, lost data, or lost goodwill, arising from your use of or inability to use the service. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the period during which the issue arose.
13. Suspension and termination. We may suspend or end your access to YT Picker if you break these terms, misuse the service, or where we are required to by law. You may stop using the service at any time. Sections that by their nature should survive termination, such as those on intellectual property, disclaimers, and limitation of liability, will continue to apply.
14. Changes to these terms. We may update these Terms and Conditions from time to time. When we do, we will update the date at the top of this page. Continuing to use YT Picker after a change means you accept the updated terms.
